LIMITED WARRANTY TERMS AND CONDITIONS

K&A MINI SPLIT-DUCTLESS AIR CONDITIONER AND HEAT PUMP

Subject to the terms and conditions of this Limited Warranty Statement (the “Limited Warranty”), K&A warrants the original purchaser of this DUCTLESS MINI SPLIT system (as used herein “System” shall mean DUCTLESS MINI SPLIT outdoor and indoor components connected via refrigerant piping, and electrical wiring) purchased on or after the corresponding manufactured date of the system and installed by a licensed HVAC contractor within the United States, that:

Section A:

The parts are warranted to the original purchaser with the corresponding proof of purchase, for a period of one (1) year from the date of purchase and it MUST be installed  by a licensed HVAC contractor. If it should prove defective due to a manufacturer faulty part within one (1) year from the date of purchase, K&A will provide a replacement for any defective part without charge for the part. Replacement parts are warranted for the remainder of the original 1-year warranty period. Parts used for replacement may be of like kind and quality and may be remanufactured. Defective parts must be made available to K&A in exchange for the replacement part and become the property of K&A.

Section B:

The compressor is warranted to the original purchaser of the system with the corresponding proof of purchase, for a period of five (5) years from the date of the purchase and it MUST be installed by a licensed HVAC contractor. If the compressor should prove defective due to manufacturer faulty compressor for a period of five (5) years from the date of purchase, K&A will replace the defective compressor without charge for the compressor. Replacement compressors are warranted for the remainder of the original 5-year warranty period. Compressors used for replacement may be of like kind and quality and may be new or remanufactured. Defective compressors must be made available to K&A in exchange for the replacement compressor and become the property of K&A.

Section C:

NO LABOR. This Limited Warranty does NOT include labor or any other costs incurred for service, diagnosing, maintenance, repair, removing, replacing, installing, complying with local building and electrical codes, shipping or handling of defective or replacement K&A product, compressor or parts. The purchaser is solely responsible for all labor and other costs of diagnosing, maintaining, installing, replacing, disconnecting, or dismantling the System and any parts in connection with owner-required maintenance, including but not limited to cleaning and/or replacing air filters System, and the Limited Warranty does not cover labor or other costs associated with such owner-required maintenance. Please refer to the associated indoor unit’s Operation Manual for air filter cleaning procedures.

Section D:

PROPER INSTALLATION; PROOF OF PURCHASE. This Limited Warranty applies only to Systems that are installed by licensed HVAC contractors who have completed any required HVAC training classes and who install the Systems in accordance with (i) all applicable building codes and permits; (ii) K&A installation and operation instructions; and (iii) good trade practices. K&A may require satisfactory proof of purchase, proof that a certified HVAC contractor performed the installation and start-up of the System as a condition to providing replacement parts under this Limited Warranty.

Section E:

TO OBTAIN WARRANTY PARTS:

Contact the licensed HVAC Contractor who installed the K&A MINI SPLIT-SYSTEM  (K&A outdoor unit, K&A indoor unit, and Controllers) or another licensed HVAC contractor or servicer and have the unit professionally diagnosed.

Proof of purchase date is required when requesting warranty parts. Present your sales receipt or other document which establishes proof and date of purchase. In the absence of acceptable proof, the warranty will not be valid but you will have the option to purchase the part you are requesting.

The LIMITED WARRANTY is only valid within the United States and Canada.

Section F:

  1. THIS LIMITED WARRANTY DOES NOT COVER: property damages, malfunction or failure of the System, or personal injury caused by or resulting from: (a) accident, abuse, negligence or misuse (b) operating the System in a corrosive or wet environment, including those containing chlorine, fluorine or any other hazardous or harmful chemicals or environmental factors, including sea- or salt-water; (c) installation, alteration, repair or service by anyone other than a licensed contractor or other than pursuant to the manufacturer’s instructions; (d) improper matching of System components; (e) improper sizing of the System; (f) improper or deferred maintenance contrary to the manufacturer’s instructions; (g) physical abuse to or misuse of the System (including failure to perform any maintenance as described in the Operation manual such as air filter cleaning, or any System damaged by excessive physical or electrical stress; (h) Systems that have had a serial number or any part thereof altered, defaced or removed; (i) System used in any manner contrary to the Operation Manual; (j) freight damage; or (k) events of force majeure or damage caused by other external factors such as lightning, power surges, fluctuations in or interruptions of electrical power, rodents, vermin, insects, or other animal- or pest-related issues. (l) Labor or other costs incurred for diagnosing, repairing, removing, installing, shipping, servicing, or handling of either defective parts, or replacement parts, or new units. (m) Any product not installed pursuant to any applicable governmental minimum efficiency standards. (n) Normal maintenance as outlined in the installation and servicing instructions or owner’s manual including coil cleaning, filter cleaning and/or replacement, and lubrication. (o) Failure, damage or repairs due to faulty installation, misapplication, abuse, improper servicing, unauthorized alteration or improper operation. (p) Failure to start or damages due to voltage conditions, blown fuses, open circuit breakers, or the inadequacy, unavailability, or interruption of electrical, Internet service provider, or mobile device carrier service or your home network. (q) Failure or damage due to floods, winds, fires, lightning, accidents, corrosive environments (rust, etc.) or other conditions beyond the control of Company. (r) Parts not supplied or designated by the Company, or damages resulting from their use. (s) Products installed outside the U.S.A. or Canada. (t) Electricity or fuel costs or increases in electricity or fuel costs from any reason whatsoever including additional or unusual use of supplemental electric heat. (u) Any cost to replace, refill or dispose of refrigerant, including the cost of refrigerant. (v) ANY SPECIAL, INDIRECT OR CONSEQUENTIAL PROPERTY OR COMMERCIAL DAMAGE OF ANY NATURE WHATSOEVER.

Section G:

WARRANTIES MADE IN THIS WARRANTY ARE EXCLUSIVE AND MAY NOT BE ALTERED, ENLARGED, OR CHANGED BY ANY DISTRIBUTOR, DEALER, OR OTHER PERSON, WHATSOEVER
